Once again, the Rubik’s Cube shape has been denied trademark protection. So has the EU Court of Justice ruled in its judgment issued on July 9, 2025, essentially reiterating that a potentially endless exclusive right, as that of a trademark for a shape that is functional to the solution of a well-known puzzle, is not appropriate.
It is also worth noting that this decision followed shortly after an order issued by the Judges of the Venice Court on April 30, 2025, which, upon extensive examination of the Rubik’s Cube’s aesthetic characteristics and its recognition in the artistic and cultural spheres, attributed its protection to copyright law.
As of today, therefore, the iconic Rubik’s Cube shape, although it is not a trademark for the EU Court of Justice, it is considered a work of industrial design under Italian law.
