The ‘withdrawal button’: when consumer protection becomes a design issue
With the transposition of EU Directive 2023/2673, the Consumer Code introduces the so-called ‘withdrawal button’: a measure that does not create a new right, but rather requires businesses to ensure it can be effectively applied with a single click.
Elisabetta Berti Arnoaldi explains to Borsa&Finanza how the method of exercising this right is becoming standardised across digital interfaces – a trend already apparent in the practice of the AGCM, which has long been penalising conduct that hinders consumers’ ability to withdraw from contracts.
For businesses, the message is clear: providing an abstract option to withdraw is not enough; it must be made accessible through simple and transparent processes. Compliance is increasingly becoming a matter of proper planning.
